Who qualifies for the Elderly Waiver in New Jersey? General Requirements: Individuals must be determined clinically eligible for nursing home level of care. Individuals must be 65 or over; or between 21 and 64 and determined disabled by SSA or the Division of Medical Assistance and Health Services, Disability Review Section and be eligible for Medicare or have other health insurance. They cannot be eligible for Medicaid or enrolled in other Medicaid waivers.
