  • Be a Delaware resident
  • Make a referral to the local Medicaid or administering agency office
  • Complete a Medicaid application
  • Be determined financially eligible
  • Determined by DMMA standards to qualify for a medical level of care
  • Determined eligible by the administering agency
  • Consent to participation by signing a consent form
  • Be able to be safely maintained in the community

You will receive services available through regular Medicaid State services and the HCBS Waiver you se-lect. You may be in only one waiver at a time.

Additional Information

In April 2012, Delaware’s Elderly and Disabled Waiver and the AIDS/HIV waiver were terminated as 1915(c) waivers and the authority for operating these programs was subsumed under Delaware’s 1115 waiver. The operation of these programs was also transferred from the Delaware Division of Services for Aging and Adults with Physical Disabilities to the Medicaid Managed Care Organizations (MCO) in Delaware. All of the benefits formerly available under these two waivers are now part of the MCO benefit package and continue to be available to eligible Medicaid recipients. The DDDS HCBS Waiver continues to exist as a 1915(c) waiver and is currently the only 1915(c) waiver approved for the State of Delaware. This waiver continues to be operated by the Delaware Division of Developmental Disabilities Services.

* Delaware does not currently have a Family Support Waiver. The Family Support Waiver is a proposed waiver that was never actually implemented. Delaware has been asked to submit a plan for such a waiver to the legislature in the spring of 2015, so it's still a possibility.

Delaware Waivers
  • Developmental Disabilities (DD): This waiver allows persons with MR/DD who meet the ICF/MR level of care and require residential placement to remain living at home and in the community. Services offered under this waiver include: case management, day habilitation, institutional or in-home respite care, and residential habilitation.
  • Elderly and Disabled (E&D) Waiver: Combination of three existing waiver programs: Beginning December 1, all services provided under the Assisted Living (AL) Waiver, the Acquired Brain Injury (ABI) Waiver, and the Elderly and Disabled (E&D) Waiver will be provided under an amended Elderly and Disabled Waiver. Services include: Adult Day Services; Assisted Living; Case Management; Cognitive Services; Day Habilitation; Medical Equipment and Supplies; Personal Care; Personal Emergency Response; Respite; and Support for Participant Direction.
  • AIDS/HIV Related Diseases (AHW): This waiver allows persons with HIV/AIDS who meet the hospital level of care to remain living at home and in the community. Services offered under this waiver include: case management, personal care services, respite care, mental health services, and supplemental nutrition.
